Appellate

We represent clients in state and federal appellate courts, achieving significant victories and defending favorable decisions on appeal. The appellate team includes former appellate briefing attorneys and seasoned trial and appellate lawyers. Our trial experience has prepared us to anticipate and react swiftly to any outcome.

Our appellate work has included post-verdict proceedings, motions, charge preparation, appellate briefs and oral arguments, original proceedings, and amicus briefs. We have been involved in appeals all the way to the United States Supreme Court, filing a petition for writ of certiorari that was granted by the Court.

The firm has also served as legal advisor to multi-firm joint defense groups, coordinating and supervising teams from other firms on major appellate cases.

Our appellate lawyers assist clients during the initial trial as well. When appropriate, we can help define legal theories; draft and review motions; seek mandamus relief; and preserve the trial record. We routinely handle charge conferences in the trial court to ensure a proper trial record for appeal. When a verdict is announced, we analyze the record in order to prepare for the creation and argument of motions and briefs. Our lawyers have filed amicus briefs and have been involved both in initiating and resisting original proceedings.

  • Successfully defending an African oil company in a $100 million lawsuit involving trial and appellate issues.
  • Defending a favorable ruling for a major bank on a question of first impression.
  • Prevailing on appeal on behalf of a Texas partnership and its partners in a class action securities fraud case.
  • Representing a manufacturing company in an appeal from a personal injury claim regarding a company employee.
  • Affirming on appeal a take-nothing judgment for an independent exploration company in a gas-balancing dispute.
